What is Probate?

Probate is the legal process of validating a will and authorizing the executor to administer the estate — including selling real estate. In Ontario, a Certificate of Appointment of Estate Trustee is typically required before a property can be transferred.

Who Can Sell the Property?

Only the estate trustee (executor) named in the will — or appointed by the court — has legal authority to list and sell an estate property. We work closely with estate lawyers to ensure the process is compliant and protected.

Timeline Expectations

Probate in Ontario can take anywhere from a few months to over a year depending on the complexity of the estate. We can often list a property before probate is granted with the right legal protections in place.
